Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) are a legal agreement between you and BuildIT, operated as a sole proprietorship by Genaro Martinez in the State of Washington, USA (“BuildIT,” “we,” “us,” or “our”). They govern your access to and use of our website, iOS application, and related services (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service and beta status

BuildIT is a construction and real estate project management application that includes an AI-powered interior design feature. The Service is currently offered as a private beta and is provided free of charge during this period. It is a pre-release product: it may contain bugs, change without notice, or be unavailable at times, and features may be added, modified, or removed.

Pricing for paid plans will be announced before general availability. We will give you notice before any charges apply to you.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using BuildIT, you represent that you meet these requirements and that any information you provide is accurate.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@builditapp.co if you suspect unauthorized use. We are not liable for losses caused by unauthorized use of your account.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Upload content you do not have the right to use, or that infringes the rights of others;
• Submit images depicting other people without their consent, or any unlawful, harmful, or offensive content;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems;
• Use the Service to build a competing product, or resell it, without our written permission; or
• Misuse the AI features, including attempts to generate deceptive, infringing, or harmful content.

6. Your content

You retain ownership of the content you submit to the Service, including project data, photos, and prompts (“Your Content”). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service and to provide it back to you.

You acknowledge that using the AI Designer requires transmitting Your Content (such as photos) to third-party AI providers to generate results, as described in our Privacy Policy. You represent that you have the rights necessary to submit Your Content for this purpose.

7. AI-generated content

The AI Designer produces visual concepts based on your input. These outputs are for visualization and inspiration only. They are not architectural, structural, engineering, or construction documents, are not guaranteed to be accurate, feasible, or code-compliant, and must not be relied upon as professional advice. Always confirm any design, dimension, material, or plan with a licensed professional before construction. You are responsible for how you use AI outputs.

8. Intellectual property

The Service — including its software, design, branding, and content we provide (excluding Your Content) — is owned by BuildIT and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

9. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that results — including AI outputs — will meet your expectations. This is especially true during the beta period.

10. Limitation of liability

To the maximum extent permitted by law, BuildIT and Genaro Martinez will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold harmless BuildIT and Genaro Martinez from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of any third party.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, or to protect the Service or other users. Upon termination, the rights granted to you end; sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be resolved in the courts located in the State of Washington, USA, unless applicable law requires otherwise.
